On April 2008 I asked for copies of documents relating to a “winter works programme” (07/08) and “other remedial works” which LBH had said they had agreed with Enterprise plc, a default notice issued to Enterprise plc and correspondence with Enterprise recording that they had “made it clear to Enterprise that we are expecting a number of significant improvements in standards from 1st April 2008”
A copy of the default notice was only supplied after I submitted a formal complaint. It took 60 working days compared to the statutory maximum of 20.
I did not receive any documents relating to the winter works programme etc nor did I receive an unqualified statement as to whether such documents were held, a breach of the Council’s statutory duty to “confirm or deny” .
Similarly, I have not been given copies of any correspondence with regard to the “significant improvements” nor have LBH clearly stated whether or not they hold such documents.
Having exhausted the Council’s complaints procedure I submitted a formal complaint to the Information Commissioners Office on 9th September 2008. The ICO wrote to LBH on 19th September 2008 asking them to conduct a internal review within 20 days. This was completed on 19th January 2009 but failed to adress my complaints!!!! On the 23rd Feb 09 the ICO allocated the case to one of their case resolution teams saying it might take several months before I hear anything. I complained about the delay on12th July. On 15th July I received a letter from an ICO Officer saying she had been allocated the case and that they had been in touch with Hillingdon. I raised concerns with her about the way she had summarised the case and these have been taken on board.
